make safety recommendations so it doesn't happen again. this is important because it's not just about the piece of metal but if we can make a recommendation, including oversight or anything else. >> the question was how this investigation is different from others, having the video and pictures available. on one hand, that is an excellent source of information, on the other hand, obviously there is not a lot of other specific components and things of the wreckage. certainly at this point we can identify. so that information will help in some ways but there is a lot of others that would make it quite difficult actually. >> so the question is whether it's been determined if they were on course at the time of
1:01 pm
the crash. let me emphasize again, we're less than 24 hours into the investigation, that is another question we're clearly be examined, but we don't have any information at this time. so the question is whether the pilot health or age is a consideration. those things will absolutely be looked at. medical history, his age, training, experience, certificates he held, all of that will be part of the investigation. i'm going the phone. operator, is there a question from the phone -- no question at the phone at this time.
1:02 pm
so the question is about whether what has been observed in the last moments prior to impact. what we can say is pretty clear that altitude and high speed low altitude, when nose up climbed briefly and nosed over quickly and impacted. anything further could still be investigated at this time. it's just too soon. so the question is whether the modifications of these airplanes are contributing to their safety risk but that is a question that will be looked at. we're not just interested in the metal but oversight, modifications and any aspect of this investigation will help us understand the cause but the kind of safety recommendations we can make to make sure it doesn't happen again. that will be absolutely be looked at investigators.
1:03 pm
>> we're going fake one more, please. i'm sorry. >> so the question was whether or not recommendations could be in the area of actually moving spectators back. that is an area that will be looked at and i think it's important we will identify the cause and make safety recommendations. if we identify anything that is appropriate to actually put out an urgent recommendation we could do that before the end it was analyzed. that will be looked at. if we get climbing is an issue, we can send urgent information in that area. i want to highlight that periodic updates will be provided. public affairs people will let you know. i'm going finish to thank to the

first responders for all their efforts. i know the mayor of reno is here. we acknowledge him and thank you sir. there has been a lot of effort and support. >> gregg: new update from the ntsb on that deadly air show crash. federal investigators raising the death toll. we didn't know this until moments ago, nine people in all were killed when this pilot lost control, nose diving toward the bleacher section of the grandstand and n.t.s.b. inspector was already there when the crash happened. wreckage has been examined. pictures show a piece came off the plane. they think they have that piece. that will be the focus as will safety recommendations. there is a quote from a spectator said if the pilot hadn't pulled up the last second he would have taken out the entire bleacher section meaning hundreds could have been killed. >> it could have been so much worse.
1:05 pm
>> gregg: i'm gregg jarrett. >> heather: i'm hed heather childers. we're would b to show you pictures but word of caution. pictures are disturbing. >> heather: can you imagine, it slams into the tarmac near the crowded grandstand as gregg mentioned, sending debris in all directions. the plane suddenly pitched upward and plunged toward the ground. >> it twisted and turned and wham! it was all brown smoke and debris, no fire, started wobbling and came up and he started heading toward the stands and looks like he was going to still controlling and try to fly over the stands and get away from those. and plane just kind of turned hard, when it started coming down and he must have been

pulling on the stick to try to get as far away from the stands as possible. >> heather: casey, casey stegall joins us by phone and what you are learning there on the ground. >> reporter: heather, i'm streaming live from the airfield because the ntsb press conference wrapping up a stone's throw away from where i'm standing now. as you heard with officials speaking with the national transportation safety board the investigation is infancy stages. they have a lot of work do. it doesn't matter how many times you see this video. it sends chills all up and down your spine. take a look for yourself a lot of amateur cameras rolling and caught this on tape. some of the pilots on the ground say that they believe that the plane's elevator was damaged, an elevator on a plane is basically a flap on its surface that allows the pilots to maneuver the plane through the air.
1:07 pm
of course, that is just some of the recommendations from pilots on the ground that saw this. that is not coming from the n.t.s.b. but certainly being discussed. again, this chilling video of the p-51 mustang crashing right next on to a grandstand. debris sent flying into crowd entering dozens of bystanders. officials here on the ground say again, the death toll stands at 9 including the pilot and more than 50 people were taken to area hospitals. now, here is what we know at this point about the pilot. he was very experienced. in fact in accomplished hollywood stunt pilot he had been racing planes since 1975 and competed in more than 120 races around the country. jimmy leeward 74 years old and his family was here. they watched in horror as that plane went down and once more, he was interviewed just one day before this accident where he was explaining his game plan for

air shows very closely, flight plans are filed. they go over the plane's maintenance records, go over the medical records and things like that. a very tragic accident but really the fascinating part of this and gregg alluded to this, some people on the ground say that house of people could have been injured. it appears that the pilot may have tried to avoid the crowd as much as he could knowing that he was going down in flames. a very developing story in reno. more updates are coming. we're going to keep you updated here throughout the day on fox news. >> heather: thank you very much. casey stegall reporting for us. fox news alert, another deadly air event, this one an air show not an air race, a crash that we're just learning about, this one at 167th air lift wing in martinsberg, west virginia but

1:14 pm
back their rhetoric about obama. they have criticized the jobs plan but republicans are also nervous about their majority in congress in the house and remember, senate minority leader mitch mcconnell is trying to win the majority of the senate. incumbents in washington including obama very nervous. >> gregg: people were polled specifically on the president's jobs plan and what may be surprising. 80% think that the stimulus portion of the bill is a good idea though it's not called stimulus but spending money on the nation's infrastructure, bridges, airports and schools. that is far more than 56% that think that cutting payroll taxes is a good idea. what do you make of that? >> that is most fascinating part of the pol poll. including mitch mcconnell, i asked him about let's fix the

>> gregg: was it cold blooded murder or suicide. the atlanta jury hearing 911 call that a millionaire makes to police as his wife lies lifeless in a pool of blood at home. he now claims his wife diane killed herself. chilling words to dispatchers may paint a very different picture. take a listen. >> gregg: lis wiehl our legal analyst at fox attorney and former prosecutor david schwartz. least, he said it five times, "i shot my wife." kind of hard to now say accident, suicide. >> right. and that's of course what his defense lawyer is saying now. that's not what his words were on that 911 tape. that is what the jury is hearing obviously.
2:44 pm
what did he say at that moment when she is lying dead? i don't think this was premeditated but i think those words argue very much in favor of the prosecution and second degree murder. >> gregg: tests show than the budget was firdz from a distance of 18 inches. kind of hard to kill yourself 18 inches away, isn't it? >> absolutely consistent with suicide. >> 18 inches? i shot my wife is consistent with the story in this case. the story is that there was a fight over the gun. that ward saw his wich taking the gun to herself and he tried to take the gun away. and then the gun went off. and that certainly could take place at 18 inches away and i shot my wife is not inconsistent with suicide. >> she was 5'7", i'm 5'7". i'm trying to think if i had the gun in my hand, there is no way my arm could be 18 inches away from my head or any other part of my body. it doesn't work logically.
2:45 pm
>> if you are fighting over the gun and point it at yourself and is he trying to take the gun away. >> pulling it 18 inches, couldn't work that way. >> absolutely. >> no. >> gregg: then there is the motive. the victim was days away from giving a deposition in a lawsuit alleging her husband blew millions of dollars on a big house, expensive cars while his business was failing. lis, is that a motive. >> of course. his business was going down. he knew his wife was going to be in that deposition a couple days hence. >> saying something incriminating. >> that's where i get into the second degree not premeditated but fit of rage. had an argument about it. not going to do this. threatened her with it and got out of control. >> you are losing here. jump. >> in i'm not losing. you can find a motive anywhere. especial whether i a husband and a wife. you could find a motive on every single day. so now they came up with a financial motive. wow, that is original. that we have this financial motive. >> gregg: the defense, david, is claiming where she was drunk and depressed and suicidal.

why would a suicidal person make hours before all these plans with her friends on facebook. plans to get together. that doesn't sound like a depressed, suicidal person, does it? >> if that's what they are going to rely in this case. she is reconnecting with old friends. >> just before she dies. >> she isn't saying goodbye. talking to her daughter about wanting to have grandchildren and plans for the future. >> reconnecting all of a sudden within her old friends. >> tall about certain things. that may have been her way of saying goodbye. >> what about the way he reacts, too when he is in lockup and in the cell? >> yeah. we were showing a picture of him in the cell. he is apparently calling people and kind of giving various stories all the time he is being recorded. but maybe the most incriminating and you tell me, lis, as a prosecutor, if this is incriminating. days after the shooting is he cracking jokes, laughing and dancing while in jail. do innocently people wrongfully accused do that? >> no. you are horror stricken. even if it was an accident.

president obama in the rasmussen polls. now in the latest rasmussen polling president obama is seven points ahead of perry. meanwhile after dropping behind for a few weeks. former massachusetts governor mitt romney is back behind president obama. i'm getting whiplash going back and forth who is ahead. how do you account for that? these numbers will continue to bounce around. mitt romney was a frontrunner. he got beat up by some of his colleagues no those debates. numbers are down as people get to know him. got to remember only one out of four republicans are set on who they are going to vote for just yet. more debates are coming. if governor perry dog does better, his numbers are going to improve. the key to watch is president obama's numbers. he won because the majority of americans were ready to vote against george w. bush and that bush administration regardless of whether hillary clinton or barack obama was on the ticket

for the democrats right now the president's numbers looking weak. >> is 2012 the year for the third party candidate. >> 27% say yeah this would a great time to have a third party candidate. among all voters they say if we have to have a third party candidate 44% would like someone who proposes less federal spending than either the republicans or president obama. 11% would like to see someone who proposes more spending than both. 29% want more of a centrist candidate. among those who say that we need a third party candidate they are even more inclined towards a missally conservative approach. what is the likelihood that a third party candidate could find? you polled people on that. >> one out of six people say it's very likely.

i think we're trying to gain the system out and talk about what might happen. how might this work. really what this reflects is perhaps a belief on some that the republicans and the democrats might not be able to figure out a way to clean up the mess they have made. if they don't, something is going to have to change. >> heather: i want to know who people think that third party candidate should be. ask that question next time. move on to money issues now, scott. in terms of american debt, how do people see their households now? >> well, actually people are saying that they owe less than they did a year ago. people are trying to find ways to cut back. but overall people are in the move to retrench on spending because 65% say the economy is getting worse. 53% say their own finances are getting worse. and those debt burdens just become ongoing problem in that situation. >> gregg: doesn't look like it's going to ease up any time soon. scott rasmussen, always great talking to you. thanks for the polling data. good to see you. >> thanks.
